4. Consumer Rights and Protections
Consumer Identification and Rights
This section provides additional protections for individual customers purchasing services for personal, non-commercial use under Turkish Consumer Protection Law (TKHK), the EU Consumer Rights Directive, and other applicable consumer-protection regulations.
Right of Withdrawal for Consumers
14-Day Withdrawal Period:
- Consumer customers (individuals acting outside their trade, business, craft or profession) have the right to withdraw from the contract within 14 calendar days without giving any reason, pursuant to the Turkish Law on Consumer Protection (TKHK) No. 6502 and the Distance Contracts Regulation, and the EU Consumer Rights Directive 2011/83/EU.
- The withdrawal period begins on the date of contract conclusion (the subscription start date).
- To exercise the right, send a clear written statement to [email protected] identifying you and the contract you wish to withdraw from. Use of the EU Model Withdrawal Form (Annex I/B of Directive 2011/83/EU) is permitted but not mandatory.
- The burden of proving the exercise of the right of withdrawal in conformity with this section lies on the consumer.
Important Exception. Digital Content & Services
Pursuant to TKHK / Distance Contracts Regulation Art. 15(1)(ğ) and EU Consumer Rights Directive Art. 16(m), the right of withdrawal does NOT apply to the supply of digital content not delivered on a tangible medium, and to services that have been fully performed during the withdrawal period, where:
- the consumer has given prior express consent to immediate performance and provision of the digital service; and
- the consumer has acknowledged that, as a result, the right of withdrawal will be lost.
During account creation and at checkout, we ask you to confirm both of these acknowledgements before the Services are provisioned. If you provide them and we begin performance, your statutory right of withdrawal will not apply to the portion of the service already performed. The 30-day Money-Back Guarantee described in Section 6 below applies in addition to, and as a more favourable alternative to, this statutory exception.
Withdrawal Process for Consumers:
- 1.Send a written withdrawal notice via email with a clear statement of your decision.
- 2.Include your account email and subscription details (invoice number, plan name). A reason is not required.
- 3.We will acknowledge receipt without undue delay.
- 4.Provided the digital-services exception above does not apply, the refund will be processed without undue delay and in any event within 14 days of our receipt of your withdrawal notice, using the same means of payment used for the original transaction unless you expressly agree otherwise.
5. Subscription Cancellation
How to Cancel
You can cancel your subscription at any time through:
- •Account Dashboard: Use the subscription management section.
- •Email Request: Send a cancellation request to [email protected].
- •Support Chat: Contact our support team for assistance.
Upon cancellation, your service will continue until the end of your current billing period. No refunds are provided for partial billing periods unless specifically covered by this Policy.
Automatic Renewal
Subscriptions automatically renew unless cancelled before the renewal date. You can cancel automatic renewal while keeping your current subscription active until expiration.
6. Refund Policy
Money-Back Guarantee
30-Day Money-Back Guarantee for new subscribers:
- Available only to first-time subscribers within 30 days of initial subscription.
- Full refund provided if not satisfied with core monitoring features.
- Request a refund by emailing [email protected] with account details.
- Once approved, the refund is issued to the original payment method; actual settlement time depends on your bank or card issuer.
Service Outage Credits
Extended Service Outage Practice:
- Where a verified extended service outage materially affects your use of the Services, we may, at our discretion, issue a pro-rated credit calculated on the downtime duration as a percentage of the affected billing period.
- Outage credits are not automatic. To request one, contact [email protected] with the affected time window and the impacted monitors or accounts.
- Credits are applied to the next billing cycle by default; a cash refund may be issued in lieu of credit on request, where reasonable.
Billing Error Refunds
We will issue a full refund for any verified billing error, duplicate charge, or unauthorised payment. Contact [email protected] without undue delay if you notice any billing discrepancy.
Refund Method and Currency
- Refunds are processed using the same payment method used for the original transaction (credit card, debit card, or bank transfer), unless you expressly agree otherwise.
- Refunds are issued in the currency in which the original payment was made. Any exchange-rate differences applied by your card issuer or bank are outside our control.
- Settlement time for refunds depends on your bank or card issuer and is therefore outside our control. Where the original transaction was processed through a local payment provider and a corresponding instalment plan has already been registered by your card issuer, refunds may take additional time.
- For consumer withdrawal under TKHK / Directive 2011/83/EU, the refund is initiated without undue delay and in any event within 14 days of receipt of the withdrawal notice, as required by Art. 13(1) of the Directive.
7. Dispute Resolution and Governing Law
This Policy is governed by the laws of the Republic of Turkey, without regard to its conflict-of-laws rules. Mandatory consumer-protection rules of the country in which the consumer is habitually resident (including those implementing Directive 2011/83/EU within the EU/EEA) remain applicable where they provide more protective rights.
Consumer Customers (Turkey):
- For disputes whose value is below the annual monetary threshold set by the Ministry of Trade, consumer customers may apply to the competent District / Provincial Consumer Arbitration Committee (Tüketici Hakem Heyeti) of their residence or of the place of the transaction. The threshold is updated yearly; please consult the Ministry of Trade for the current amount.
- For disputes above the threshold, the competent forum is the Consumer Court (Tüketici Mahkemesi) or, where one does not exist, the relevant Civil Court of First Instance.
- Consumers may also use the EU Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.
Business Customers:
The Istanbul Anadolu Courts and Enforcement Offices (İstanbul Anadolu Mahkemeleri ve İcra Daireleri) shall have exclusive jurisdiction. Nothing in this section prevents the parties from resolving disputes through mediation or arbitration where mutually agreed in writing.
Nothing in this Policy excludes or limits liability where such exclusion or limitation would be unlawful under applicable consumer-protection law.
